A commercial lease in NSW is an interest in commercial premises granted by one party, the ‘landlord’, to another party, the ‘tenant’. The landlord confers a right on the tenant for exclusive possession of the premises for a certain period of time. Most retail leases are subject to the terms of the Retail Leases Act of 1994, while commercial leases are for the most part decided between the landlord and tenant. Lease disputes tend to arise arise during a market rent review, in which the landlord reassesses the amount of applicable rent owed by the tenant.
